SMS consent disclosure

Leveled Apps, LLC, operating as Leveled Studio, sends text messages on behalf of participating local businesses. This page publishes the exact consent language those businesses display when they collect a mobile number, so that anyone, including a recipient or a carrier reviewer, can see precisely what a person agreed to. Opt-in path 1: web form or quote request
Every participating business displays a checkbox beside the phone field on their contact, quote, or booking form. The checkbox is not checked by default, is separate from any terms of service checkbox, and submitting the form is possible without it. The label reads:
"I agree to receive text messages from [Business Name] about my inquiry and appointment scheduling, sent by its messaging provider. Message frequency varies. Message and data rates may apply. Reply STOP to opt out, HELP for help. Consent is not a condition of purchase. See the Privacy Policy and Terms."
Marketing consent, where a business also wants to send promotional offers, is a second and separate unchecked box. A person who ticks only the first box receives replies to their inquiry and nothing promotional.
Opt-in path 2: you called the business
If you call a participating business and nobody can answer, we reply by text to the number the call came from, so your inquiry is not lost. The consent basis here is your own call: you dialed the business, and the number is the caller ID your carrier delivered with it. That first message identifies the business by name and carries opt-out instructions, as required. We record the call as the consent source for that contact.
These replies are responsive to your call. They are not promotional, and a business cannot use this path to send marketing.
Opt-in path 3: existing customers
For re-engagement messages to a business's past customers, consent is collected at the time of service on the intake, booking, or membership form, using this language:
"I agree to receive text messages from [Business Name], including appointment reminders and occasional offers, sent by its messaging provider. Message frequency varies. Message and data rates may apply. Reply STOP to opt out, HELP for help. Consent is not a condition of purchase. See the Privacy Policy and Terms."
Before any re-engagement campaign runs, the business attests in writing that every contact on the list agreed to this, and identifies where and when consent was captured. Contacts whose consent cannot be verified are marked unmessageable and are never messaged. We do not message purchased, rented, or scraped lists, and we will not accept a list assembled that way.
How consent is recorded
Consent status and its source are stored per contact and checked before every single message. Our software will not send to a contact whose consent is not verified; that check is enforced in code and again at the database, not left to an operator to remember. Opt-outs are permanent and are honored before anything else happens to a message.
Opting out and getting help
Reply STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any message to opt out. You will receive one confirmation and then no further messages from that program. Reply HELP for contact information. You may also email contact@leveledstudio.com at any time.
